By accessing or using Pixly ("Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. We may update these terms; continued use after changes constitutes acceptance of the revised terms.
Pixly provides online wedding galleries, guest contributions, and related features. We may modify, suspend, or discontinue parts of the Service with reasonable notice where practicable.
You are responsible for safeguarding your account credentials and for activity under your account. You must provide accurate information and notify us of unauthorized use.
You retain ownership of content you upload. You grant Pixly a non-exclusive, worldwide license to host, store, process, display, and distribute your content solely to operate and improve the Service for you and your invited guests.
You represent that you have the rights to upload the content you submit and that it does not violate third-party rights or applicable law. Wedding hosts are responsible for guest access and moderation settings for their events.
You agree not to:
We may remove content or suspend access for violations of these terms or to comply with law.
Paid plans, billing cycles, and refunds are described at checkout and in any order confirmation. Failure to pay may result in suspension of paid features.
The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation.
To the maximum extent permitted by law, Pixly and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data. Our aggregate liability arising from these terms or the Service will not exceed the greater of amounts you paid us in the twelve months before the claim or one hundred dollars (USD), except where liability cannot be limited by law.
You will defend and indemnify Pixly against claims arising from your content, your use of the Service, or your breach of these terms, to the extent permitted by law.
These terms are governed by applicable law, excluding conflict-of-law rules. Disputes will be resolved in the courts of competent jurisdiction, except where prohibited by law.
